Terms of Business for Permanent Recruitment

1. Scope of terms:

These Terms will apply to all permanent recruitment conducted by Aged Care Recruitment and may only be amended in writing by its Director: Ms Helen McAfee.

2. Acceptance of terms:

 Acceptance of these terms will involve agreeing to the terms and conditions specified in this document.

3. Entitlement to fees:

 Fees are payable by the Client prior to receipt of a service.

4. Advertising:

 Aged Care Recruitment may advertise on behalf of the Client and at the Client's cost, at rates set out on the Products Page. Advertising charges are payable in advance. Where the Client cancels an advertisement, they will be liable for any costs associated with the cancellation. This includes the full cost of the advertisement where withdrawal is not possible due to media booking deadlines. No advertising will proceed without explicit endorsement by the client.

5. GST:

 All fees and charges quoted by Aged Care Recruitment include GST.

7. No Warranty:

 Although Aged Care Recruitment conducts wide-ranging research to: locate; catalogue; cross-reference; profile; screen; interview; and conduct both psychometric and qualitative assessment to provide a reliable short-list of candidates, Aged Care Recruitment makes no warranty as to the suitability of any candidate to a particular position. It is ultimately the responsibility of the Client to ensure that a Candidate is suitable to the position to which they are appointed.

12. Payment terms:

Fees related to the itemised services are payable online prior to the receipt of the service. Fees negotiated outside these parameters are subject to a legally binding contractual arrangement.

13. Offers of employment:

 Aged Care Recruitment may make a verbal offer of employment to a Candidate on instruction from the Client.

14. Occupational Health & Safety and Equal Opportunity:

The Client will agree to accept responsibility for ensuring that Occupational Health and Safety Legislation is adhered to. This responsibility will apply to any aspect of the workplace environment including ensuring any plant or equipment used is safe. Without limiting the generality of this obligation the Client agrees that they will establish safe work procedures, communicate safe work procedures to the Candidate, comply with safety standards, comply with all health or safety legislation or regulations, and provide a harassment free workplace in accordance with the relevant legislation. The Client further agrees the Candidate will only be requested to perform work or use equipment that they are familiar with, are qualified to use, or that they have been adequately trained on. The client agrees that any employee will not be requested to engage in any work or use any equipment that they are unqualified or unfamiliar with. The Client will also ensure that Human Rights and Equal Opportunity legislation is adhered to.

15. Privacy legislation and confidentiality:

 Aged Care Recruitment is legally and ethically bound to adhere to these provisions. This will require us to obtain signed informed consent forms from all our clients agreeing to the conditions for administering these requirements.
